I am requesting an amendment to the spelling of "mahaul".
I think it would sound better if we spelled it as "mahole" :D

    :DGuys ,
The "mahaul"(environment) seems so Tense around the IV forums that I thought of making a thread to share some light humor / Jokes etc

Here are some funny quotes to start with

I don't think President fully understands this immigration thing.
Like today, when they asked him about amnesty, he said it's horrible
when anyone loses their memory." --Jay Leno

"As you know, today was Don't Take Your Immigrant To Work Day
here in Los Angeles. No, all across the nation they had a Day Without
Immigrants, is what they call it. Or, as Native Americans call it, the
    good ol' days." --Jay Leno

    Very insightful.

So in essence they give the boiler plate RFE's to drag you into a trap and once you oblige with the irrelevant info asked for in the RFE's, then the game is over. so we need to be very careful with the information we provide and need to be consistent no matter what is asked for.

    Yes, that is correct.

I will give you what was asked for in my local office interview:

w2's tax returns from 1999 through 2006 to prove that I complied with my status upon each entry into USA.

    I-134 affidavit of support

    All passports

Updated and new G-325a (old one I had completed in 2003)

Letter from employer giving detailed job description; salary

    last three months paystubs

Company two years of tax returns

Company two years of DE-6 (state unemployment compensation report which lists all employees names including mine and other names can be blacked out).

    --------------------------------------------------------------------

My situation; entered USA on TN back in July 1999

Last entry before filing I-485 in May 2003 was December 2002 (therefore, he should not have asked for w2's; paystubs prior to december 2002).

I-140 was filed in May 2003 but approved in April 2004. left sponsoring employer at end of 2004.

From Jan. 2005 listed one company and then from October 2005 to March 2007 showed that I was self employed.

Did not have any tax returns prepared or w2 for 2005 and 2006 and no three months of paystubs (self employed).

I was going to take another job offer with another company upon greencard approval; therefore; I gave that companies two year of tax returns but no DE-6 because I wasn't working with them yet.

    -----------------------------------------------------------------------

When I gave updated g-325a; it shows me as being self employed. He immediately picked up on this. I told him that it was allowed according to May 2005 memo and that I was in a period of authorized stay by filing the 485 in May 2003 and I had an EAD card and it was unrestricted employment.

Also, informed him that I was not porting to self employment upon greencard approval but instead going to work for another company. I gave him company job offer letter; told him since I didn't start working with them yet; then paystubs were unnecessary and that de-6 was also unnecessary since I hadn't started to work with them.

He asked for tax returns and w2's from 2001. As I was giving it to him; I questioned him why he was asking for this; I told him that I only needed to prove status from date of last entry until filing 485. (december 2002 to may 2003). He didn't say anything to this.

He got to 2005 and 2006 and I told him I didn't have tax returns prepared yet and no w2 since I was self employed. He asked for extension from IRS; told him I didn't file extension because I didn't owe any taxes. He dropped the questioning right there.

He then said case is approved.

Now; he way overreached in what he was asking for; if I didn't know these immigration laws then maybe someone would have gotten paystubs made or did fake tax returns, etc., and if USCiS officer suspected something and asked for certified IRS transcripts or called the company then he would have nailed me. Essentially; he was almost trying to get me to fake these things even though they are not required.

Does this mean that H1B is also location specific?

As far as I know, yes it is...I remember doing H1 myself few years ago and the LCA form has prevailing wage rate section. As we know, the wage rates differ from place to place and so since H1 is based on prevailing wage rate on LCA, then H1 is also location specific. Even though LCA form has been changed since then, I think it still holds true...

Well, if one provinance is joined hands with the theives then the police from second provinance should kick the other provinance's theives and police (as*).And yes a possible revilary between two provinances.

Suppose there are theives from Bihar that come and rob you in West Bengal.
You can either send your West Bengal police into Bihar, and turn it into a rivalry between two police departments. And a rivalry between two provinces.
Or you have the two police departments work together to reduce crime rate in the future.

Dude, you are one confused person.........whats the point here??
EB-3 India is somehow "special" and all you whiners in EB-3 India should get your GCs before EB-2 folks becuase blah blah blah........WHAT???

are you insane?? you make no sense in your argument.

    Numbers fall as EB1--> EB2 --> EB3.

Dont like it, go get an education and/or an EB-2 level job. Else shut up. You have nothing to say.

    Hi kutra,

Good post I can understand what you want to do here, you are diffusing the tensions between EB2 and EB3. I hope many more people write posts like you and I appreciate it. But factually what you said is not correct "The US immigration system wants EB1 first, then EB2 and then EB3".

What I am posting here I sent the same in private messages to some other members and it helped to diffuse this bad arguments between EB3 and EB2 folks.. I am posting here because I thought with this I can give the right(my?) perspective on this and bring some sanity to these arguments.

Here is my take on this EB1, EB2 and EB3.

Out of the total 140K each EB group gets equal quota of 33.33%. So if each EB group gets equal quota of 33.33%, then what and where is the priority? EB1, EB2 and EB3 are just groups, it just means that US need these categories of jobs to be filled by immigrant workers.

By definition always number applications filed in EB3>EB2>EB1 there is no argument there. And the waiting time also will be EB3>EB2>EB1. That is fair, there is no competition here across groups, each have a quota and its own queue, every one competes with in the group.

If first, all(9K Ind)(140K Total) Visas are given to E1 and any leftover are given to EB2 and then any leftover from EB2 are given to EB3 then you can say the priority is EB1>EB2>EB3. The spillover that to from a particular preference has priority I understand. But at the least every group will get its 33.33% if those many category applications are present in that group.

Yes, unused ROW EB1 go EB2 and then to EB3. Yes unused ROW EB2 and ROW EB3 and to EB3. That makes sense and it dos not contradict what I am saying. Now EB2 is special case that there are lots of EB2 India applications are pending so they get only the spillover from EB1.

I agree with you on your statement below, and I feel the same way. Looks like if either Eb2 or EB3 is mentioned in a thread it turning into a bad arguments between EB2 and EB3 hope this ends soon.
As I wrote earlier, I'm an EB3-Indian as well. Only differences being, I have still maintained my sanity, and I have the patience to wait for IV to deliver the official guidance on proceeding further.

I think much of India understands this perspective.

    I hope so.

I agree with most of what you said. I just think that the expectation to shed the inertia built over two to three decades is a bit too much. It is going to take time, regardless of what anyone wants. Ironically, hostile relationships between India and Pakistan are only going to prolong the process.

This whole GC process is unpredictable. Don't waste ur life for it. Do whatever u think is best for you. It will be America on the loosing side if they deny u the GC after u have bought the home.
it is not just america losing - the person who has bought the house would lose his downpayment / equity too -not to speak of the mighty credit score - am I right ??
depends on yr situation and your priorities and more important the place where you are planning to buy. is it in florida, mich, Ohio, california or nevada (I guess no - else you would not have asked this question). if you think of a house as investment and you dont want to take a loss - then wait. if you need the space desperately and you are o.k with the prospect of yr house depreciating for couple of years - then go ahead and buy. BTW there was another thread where this was discussed in detail

    Hello,

Though housing market may still have room to fall and not rise again for next decade or so, there are some factors to consider in 2009 that could tilt the decision in favor of buying a house:

    1. Location - If you are not in bad markets like CA, NY, FL but in more stable ones like TX, you should evaluate
    2. Taxes - If you've AGI above 300k, buying house is one of the few options left to reduce your tax bill
    3. Affordability - If your monthly mortgage, interest and maintenance payments are comparable to current rent amount (as taxes are adjusted during tax filing) and affordable even when you move out of US, buying house should be an option
    4. Price - If you are looking at localities where prices are close to 1995-2000 levels and the particular property has held the value steady, then buying the house could be an option

    Just my 2 cents... :)
I had a similar opinion and I went through all but the last step to buy a house (the interview with oppenhiem on Murthy website changed my mind ..ofcourse my 4 buyer agents were terribly disappointed... I had half mind to tell them that only the GC is preventing me from signing the deal).
the reason that I backed out is (this is in my case only ..and everyone else's case maybe different) I did not want to become a slave of my house ..i.e. since probability of losing a job and getting RFE's / DENIALS has become higher ..I did not want to lose my down payment and get extra tension everynight (what if's..). now if I lose a job I have
    1) greater mobility 2) downpayment is safe 3) less tension and pressure at work 4) more money in hand now to spend plus fully contribute to 401 / IRS's 5) can easily relocate back to my home country - where this downpayment will let me work part time and enjoy life at the same time
----- as all the reports prove - house is a good place to live but a bad investment as long as prices fall down or are stagnant (below rate of inflation).
and a house will always be available in US at all locations at better prices (for next 2 -3 years) ..land is plenty, homes are even more in supply (by some estimates 2 years of supply), baby boomers, flippers, investors bought 2-3 homes)and normal people selling their homes

The Lobbying Disclosure Act of 1995 (http://www.senate.gov/reference/reference_index_subjects/Lobbying_vrd.htm) establishes criteria for determining when an organization or firm should register their employees as lobbyists. Lobbyists register with the Senate Office of Public Records (SOPR (http://www.senate.gov/pagelayout/legislative/one_item_and_teasers/opr.htm)). SOPR receives, processes, and maintains for public inspection records filed with the Secretary of the Senate (http://www.senate.gov/reference/office/secretary_of_senate.htm) involving the Lobbying Disclosure Act, the Federal Election Campaign Act (http://www.fec.gov/law/feca/feca.shtml), the Ethics in Government Act, the Mutual Security Act, and the Senate Code of Official Conduct. If you can smile when things go wrong , you have someone in mind to blame.

The sole purpose of a child's middle name is so he can tell when he's really in trouble.

Did you ever notice: When you put the 2 words "The" and "IRS" together it spells "Theirs."

Aging: Eventually you will reach a point when you stop lying about your age and start bragging about it.

The older we get, the fewer things seem worth waiting in line for.

Thanks. I will look into it further when I get a chance. the number of GC granted in a year is complicated- and for the moment I speak offhand so correct me if needed. Till 2005, the recapture clouded the numbers. After that EB3 benefited from a Schedule A recapture that went almost entirely to EB3, a lot to EB3 Philipenes and a good chunk to EB3 India.

AFAIK last year though, once that was ll over and vertical spillover was implemented, EB2/EB3 Inid should both have got only the strict country quota mandated GC numbers.

Anway- offhand as I said...gotto rum.

    sc3,

here are the allotments as posted elsewhere.

    2003 2004 2005 2006 2007 (EB India allocations)
    ------------------------------------
    EB1 1,266 2,998 6,336 3,156 2,855

    EB2 8,536 16,262 16,687 3,720 6,203

    EB3 10,647 19,889 23,250 3,006 17,795

Continuing on what i said- till 2005 there was recapture. 2006 reflects what would happen with a vertical spillover for both EB2 and 3 India- about 3,000 GC a year. In 2007, both (esp EB3I) struck pay dirt because everyone became current in July. Under a situation where all categories are current, Gc are distributed exclusively by RD and country quota is thrown out of the window. That is why so many GC were given to EB3 I last year- it makes sense because this is the largest waiting group.
However July 07 is not coming back. If vertical spillover continues, 2006 will become the reality. In that situation the waits for both EB2 and EB3 India will be simply indefinite. Unfortunately for EB3 I, they are indefinite either way- UNLESS we get more GC numbers.

There are many uses for this. If you look at the bottom left hand corner of g-325a there is some annotations to it. One of the g-325a's get sent to the consulate. Now; what does the consulate do with it???? Do they compare it with your original visa application of what your last occupation/address was?

Do you really think they would send the G-325a to the consulate? Do the consulates keep all the records? For how long? I heard from immigrationportal, somebody said they only send G-325a to the consulate if one applied a visa within one year prior to AOS application. Can anyone confirm this?

If they send everyone's G-325a form to the consulates, would that result in another backlog? Thanks.

Our Nation as a Startup (http://blogs.wsj.com/indiarealtime/2010/12/29/india-journal-our-nation-as-a-startup/) By Rajeev Mantri | IndiaRealTime

Doing business in India can be overwhelming for somebody accustomed to working in a more hospitable business environment. The World Banks Doing Business study ranks India 134th worldwide for ease of doing business, behind lesser-talked- about nations such as Tanzania and Ghana.

Besides the well-documented inadequacy of physical infrastructure, archaic corporate and taxation laws are yet to catch up with modern ways of structuring and operating new ventures. Yet India is able to register high rates of economic growth year after year.

U.S. President Barack Obamas contention that India has already arrived is magnanimous India is a startup with high potential but hasnt made it yet into the pantheon of world powers. Like a startup, India is chaotic and unpredictable.

Democracy adds another twist in the tale. As the last three months have shown, Indian politics can turn on a dime and the perception of political stability can give way very quickly. Indias business model is contrary to how other Asian economies have developed: India continues to be services-driven and domestically-oriented instead of being heavy on export-led manufacturing.

This approach shielded the economy during the financial crisis. With growth driven by high-quality entrepreneurs who have been able to deliver despite a suspicious and often obstructionist state, its no wonder that investors continue to be bullish on India and tend to overlook major political and geopolitical risks.

But high growth brings with it many quandaries. Though a happy problem to have, a growing enterprise faces its own management challenges. At the very least, the capacity of Indias executives and government to manage growth has been somewhat disappointing. India chose (some would argue that it stumbled upon) a bottom-up development model based upon entrepreneurship.

We are now reaching a stage in the economic cycle where we need to push the envelop further, not negate the strategy that has served us very well over the last two decades. India saw two bursts of significant reform, from 1991 to 1996 under Prime Minister P.V. Narasimha Rao and again from 1998 to 2004 under Prime Minister A.B. Vajpayee. Since 2004, there has been virtually no reform initiated by the Congress-led United Progressive Alliance government in areas such as labor law, where the current regime is constraining growth in manufacturing. This is impairing the quality of Indias economic growth and limiting job creation.

Recently, Steve Jobs said that his company, Apple, is the worlds largest startup. Its an interesting view given that Apples market capitalization, which is close to $300 billion, makes it one of the most valuable companies in the world. Apple also has zero debt and tens of billions of dollars in cash. From the brink of bankruptcy and irrelevance in 1998, Apples financial and competitive strength is now the envy of the technology industry.

When Mr. Jobs returned as Apples CEO, he had a straightforward mantra: To rebuild Apple as a pioneering innovator and rescue it from the morass of creating me-too products, as he put it. He felt that the company he founded had forgotten what it stood for. This was audacious for a company struggling to stay on its feet.

Indian administrators and policy-makers should also remember how high rates of economic growth have been achieved in the first place. Like a startup which has achieved a fit between product and market fit and is ready to scale up, India needs to continue providing its entrepreneurs with the space and environment to operate.

Apple lost its mojo because it abandoned the strategy that made it what it was. Curiously, that strategy itself was not rigid and inflexible but one of continuous innovation, where Apple would make its products irrelevant before its competitors could. A return to this thinking has ensured the companys rise through the 2000s. India, too, needs to return to policies that have transformed its economy from anemic to blistering growth.

In Hindu philosophy, The Upanishads talk of the concept of Atmanam Viddhi, which roughly translates as knowing oneself. It turns out that self-knowledge is also a sound business strategy to reach where you want to go, its first important to know how you got to where you are.

The government must realize what it is that has delivered high rates of economic growth. Negating the ideas and policies that are driving Indias economic development by delaying the next round of economic reforms could prove to be immensely damaging to Indias economic prospects. India needs a visionary leader to step up and push through some of the changes that most agree need to be implemented but few have the political courage to execute or else an opportunity may be lost again.

I heard about Prithvi Raj killing Ghori and it's called Shbda Bhedi Bana Vidya.
They say that Prithvi raj knew Shabda Bhedi vidya.

Correct, that's what the legend says. However the point here is that the bad practice of insulting Prithviraj by making tourists and visitors step on his grave is still followed in Afghanistan!

Worst part, it were the Afghans who attacked Pakistan, although I'm sure Pakis will say it was Indians who attacked Afghanistan just as they said Hindu fundamentalists attacked Mumbai!:D
I'm sometimes amazed how much a religion can drive a person crazy! It will make people believe anything.

An interesting bit of history about Chauhans.
    http://en.wikipedia.org/wiki/Chauhan
In India, Chauhans are predominantly Hindu. In, Pakistan Chauhans are virtually all Muslim. The tribe and descendants of Prithvi Raj Chauhan were captured by Shahab ud din Ghori, while travelling through salt range on way to Afghanistan on night Gakhars of region attacked and killed the Ghori warrior and Chohans escaped to the hills and converted to Islam. The descendants of Chohan are found in Chakwal region and salt range.
Chauhan Rajputs also converted to Sikhism though most of them call themselve Jatts now but they have common heritage with Chauhan Rajputs. Most of them are from Yamuna Nagar, Ambala district from Haryana.

OBAMA is for lesser H1B but more EB GC. He prefers workers who are entering the US to have intention to stay permanently than temporarily because it helps the economy.

That's the wisdom of Durbin amendment. Lesser H1B because you will get GC instead.

Everyone say "H1b is not good we want more GC". Then the whole thing moves towards a new points based system and everyone will support it saying - this will ensure US will have best and brightest. What happens to us???? We will be ignored

Thanks UN. Gosh!! this thread is an autopsy of current affairs in EB immigration. Very good going, with what is now a misleading title.

Do they have any filtering mechanism for lot of these fake future employer GC apps through sister/subsidiary or pay for GC companies. We have had few people come on these forums before or after approval of GC asking what happens if they never work for the sponsoring company.

I personally know someone who got a GC in 2002 without ever working(not for sponsoring employer or even for some other company) and since never worked in the field they got GC. I bet that involved a lot of faking but slipped through every test.

You see on all these ac21 issues we rely on uscis memos. Every one of these memos state pending change to the regulations; we are going to follow the principles of this memo.

it has been 8 years and they still haven't changed the regulations. Memos can be changed at their whim at any time.

Currently; uscis position is that if someone ports to another company; they are not supposed to check the ability to pay criteria. However; they left themselvees an out that theey can check the genuineness of the ac21 employer. Becasuse of this last statement; what they have been doing is asking for ac21 employer tax returuns, and quarterly wage reports. If you are already on payroll then size of company doesn't matter. However; if you are not on payrroll and it is a very small company then they can challnge it.

btw; I am not epecting quota to finish early this year. Many companies/lawyers are very frustrated with h-1b right now. I was talking to education evaluator and he told me that there is litteally no business right now. Companies I know of how filed 70 cases last year are not filing any this year due to a combination of issues (iowa issue, lack of approvals and great demand for tansfers by thos who were laid off or had theirr h-1b's cancelled.

Right now; newer companies who don't have much experience with h-1b are going into the lions den without knowing there is a lion in there.

    alisa,
It looks very funny when I heard word " Non-state actor" by President Zardari.
When world is asking Pakistan government about Mumbai terror attack with a solid proof that terrorist were came from Pakistan, trained in Pakistan, and plot was masterminded in Pakistan, Mr Zardari says they are non-state actors!!!
When Indian government ask Pakistan to hand over all culprits (so called non-state actor as per Zardari), Pakistan government reply is " We can not hand over Pakistani citizens to other country. They will be bring to justice per Pakistani law"

I am not sure what the confusion is.
The Bombay gunmen were non-state actors because they were not sent by the government of Pakistan.
And I understand that Pakistan is not handing over anyone because it says that India gave it a list of the 'usual suspects'. Besides, I am not sure what kind of extradition treaty is there between India and Pakistan.

    See this too:
    http://online.wsj.com/article/SB123068308893944123.html?mod=googlenews_wsj
    See where it says:
In recent years, Lashkar and other groups have turned to waging global violence against largely civilian targets, putting Pakistan under rising pressure from its allies and complicating peace negotiations with India. The groups also are striking targets within Pakistan. They have become, said the ISI official, "a monster we've created that we can't put back in the box."

If they are non-state actors, why Pakistan government is not handing over them to India?

Whole world is convinced but Pakistan government is still want proofs!!! Pakistan is exposed to the world for continuously keep on denying and lying. Pakistan government is not at all serious to act on terror culprits. Azar Masood was released by Indian government at the time of Indian Airlines plane hijack in 1999. If Pakistan is even 1% serious, they would have taken action against him. He is openly moving across Pakistan and hundred time he address public gathering.

I think the world has changed since 1999. Pakistan has changed since then. There were activities that were undertaken in the past, and in those activities Masood Azhars were involved. India is asking for Masood Azhars after Bombay.

Personally I think that all the Masood Azhars should be rounded up and made to disappear from the planet. There is no good that can come out of them.

The real looser are small intelligent and rational educated group of Pakistan. World is detaching Pakistan and whole Muslim community. The days are not far that Pakistan is going to declare "Terrorist Sponsoring State" by the world. Alisa, you image, how much damage would be in this case!!

    I know.
That is the major battle in Pakistan right now. Between the dinosaurs that live in the past, and the intelligent life that wants to move forward. Tensions between India and Pakistan only help the dinos.
